1. Service provider
The service provider and seller of admissions and passes is Zdravie vo svojich rukách s. r. o., registered office: Osuského 3784/3B, 851 03 Bratislava – mestská časť Petržalka, Slovak Republic; company ID (IČO): 53535871; tax ID (DIČ): 2121419047; registered in the Commercial Register of Mestský súd Bratislava III, section Sro, entry 150424/B (“provider”, “we”, “us”).
Venue: APEX Fitness Club, OC MAX, Galantská cesta 5692/20, 929 01 Dunajská Streda, first floor above ground level.
Customer enquiries, complaints and withdrawal: club.apex.fitness@gmail.com, +421 949 251 571. Written notices may also be sent to our registered office. This is a self-service gym; the telephone number does not imply permanently staffed premises or continuous technical support.
2. Scope
These terms govern the purchase and use of gym admissions and passes by consumers. Our website provides information and directs customers to GYMIFY; it has no independent checkout or payment gateway. Separate GYMIFY application terms do not replace our obligations as the provider of fitness services.
Services are supplied in person in Dunajská Streda. The Slovak, Hungarian, Czech and English versions express the same rules. Website language and advertising location do not change the place of service. Customers can read and save these terms before purchasing.
3. Products and prices
| Product | Standard price | Student price | Validity |
|---|---|---|---|
| Single admission | €6.50 | €5 | One visit; any deadline for using it must be disclosed before purchase |
| 10 + 1 admissions | €55 | €40 | 11 admissions, 3 months from purchase |
| 20 + 2 admissions | €105 | — | 22 admissions, 6 months from purchase |
| Monthly pass | €48 | €35 | Unlimited admissions, 1 month from purchase |
These prices reflect the price list on the version date. The current total price in euros, including applicable taxes and any previously disclosed charges, must be shown before a binding purchase. Later price changes do not alter the agreed price or content of services already purchased. Clarify any discrepancy before paying; uncertainty is not automatically resolved against the consumer.
A month is a calendar month counted from purchase, rather than a fixed 30 days or a period starting on the first visit. Where the final month has no corresponding date, the period ends on that month's last day. Exact validity should be displayed in GYMIFY. We do not apply hidden or retrospectively disclosed expiry periods to unused single admissions.
Discounted prices apply to eligible customers. Before purchasing, contact us to establish the applicable eligibility criteria and proportionate verification method; these must be disclosed before the discounted purchase. These terms do not require a particular student card, discount age limit or copy of a medical document.
We accept MultiSport cards. Before visiting, check whether your card type is eligible and how it must be validated. Acceptance alone does not promise a particular number of admissions, surcharge or use of the ordinary QR code without further verification. Any restrictions or surcharges must be disclosed in advance.
4. Purchase, payment and commencement
All admissions and passes are purchased through GYMIFY. Customers create an account, select APEX Fitness Club and their product, check their details and total price, and submit an order in a way that clearly acknowledges an obligation to pay. Payment is cashless only, using the methods shown in GYMIFY. Customers must be able to correct their details before submitting.
The fitness-service contract is concluded when we accept the order, with confirmation provided through GYMIFY. Customers receive contract confirmation, these terms and statutory information on a durable medium, such as email or a fixed document they can save. A link to a changeable webpage alone is insufficient.
Following successful purchase and allocation of the admission or pass, customers can enter using their personal in-app QR code during opening hours. Starting the service during the withdrawal period requires an express customer request and the information described in section 8. Marketing consent does not replace that request.
Application: App Store / Google Play. Instructions are available in the app and the published instructional video. We do not promise that every payment method or feature works on every device.
5. Access and safe use
Independent exercise is permitted from 18 years of age. Anyone under 18 may exercise only with an adult who remains present throughout the visit. This does not replace legal requirements concerning a minor's capacity to contract or consent from their legal representative. An accompanying adult is not automatically a legal representative.
Use your account and QR code personally, protect them against misuse and do not admit unauthorised persons. Follow the published gym rules and hygiene and safety instructions; use equipment as intended and consider other users. Do not exercise under the influence of alcohol or other substances that impair safety. Report injuries, damage or dangerous conditions to us; call 112 where life or health is immediately at risk.
Choose exercise appropriate to your abilities and health. Consult a doctor if uncertain. This advice does not exclude our statutory obligations or liability for equipment safety or conduct for which we are legally responsible.
Current opening hours are published on the website and at the venue; check them before purchase. Showers are available, and parking is provided at the shopping centre subject to its operator's rules. Admission does not automatically include a personal trainer or guaranteed free parking. Liability for belongings left at the venue is governed by applicable law.
6. Duration and restrictions
Passes do not renew automatically. Expiry creates no new payment or membership without another purchase. Passes are normally non-transferable and cannot be frozen; an individual agreement is possible. This does not affect statutory rights concerning defective services, unavailability on our side or withdrawal.
Unused admissions ordinarily cannot be used after a properly disclosed validity period expires. Voluntarily choosing not to use an available service does not automatically entitle a customer to a refund. Rights under sections 7 and 8 remain unaffected.
Serious safety breaches or misuse of access may justify proportionate access restrictions necessary to protect people and property. We will explain the reason. Such a restriction does not automatically entitle us to retain payment for all future unprovided services or impose an undisclosed penalty.
7. Faults, complaints and liability
If an admission does not appear after purchase or your QR code fails, check payment confirmation and product validity and contact us. Provide the time, product and problem; never send your password or full payment-card details. Use of GYMIFY does not remove our responsibility for the agreed fitness service.
If a service is unavailable for reasons on our side, the nature of the problem may entitle you to a remedy, proportionate extension, price reduction, relevant refund or withdrawal where legal conditions are met. Forced closure or changed opening hours do not automatically allow us to retain payment for unprovided services.
Submit complaints by email, in writing to our registered office or by another demonstrable method. Describe the defect, identify the purchase and state your requested remedy and contact details. We will issue written acknowledgement of the defect and specify a remedy deadline which, for services, must not exceed 30 days from notification. If we reject liability, we will explain our reasons in writing. No separate complaint administration charge applies.
Nothing in these terms excludes or restricts liability that cannot lawfully be excluded, particularly for personal injury or breach of the provider's obligations.
8. Withdrawal from distance purchases
For the ordinary single admissions and passes in section 3, consumers purchasing at a distance may withdraw within 14 days of concluding the contract without giving a reason. These terms also grant that right contractually if the scope of the statutory right for a particular product would be disputed; any wider statutory protection remains available. We do not apply a blanket withdrawal exclusion merely because these ordinary products concern sport.
Send withdrawal to club.apex.fitness@gmail.com or our registered office. An unambiguous statement is sufficient; the annexed form is optional. Sending your notice by the last day preserves the deadline. You may also use the legally required online withdrawal function in the interface through which the contract is concluded; failure of that function does not restrict other methods or your rights.
If you expressly requested service commencement during the withdrawal period and received the required information, we may charge only a proportionate amount for the service actually supplied before withdrawal. For admission bundles, this is based on the total amount paid and admissions used as a proportion of all admissions, including bonus visits; for time-based passes, on the service period actually supplied as a proportion of the agreed period. This is not a penalty or automatic repricing at more expensive single-admission rates. No such charge applies where its legal conditions are absent.
The right to withdraw from a service may be lost only after full performance where performance began with your prior express consent and acknowledgement that full performance would end that right. Account creation, payment, QR-code activation or the first visit under a multi-admission or monthly pass do not by themselves constitute full performance. Missing statutory information may extend the withdrawal period as provided by law.
We will refund amounts due without undue delay and within 14 days of receiving withdrawal, using the original payment method unless another method is agreed without additional cost to you. No withdrawal penalty applies.
9. Disputes
If dissatisfied with complaint handling or if you believe your rights were infringed, you may request redress from us. If we reject the request or fail to reply within 30 days of its dispatch, you may apply to a competent alternative dispute resolution body under Slovak Act No. 391/2015 Coll.
A competent body may be the Slovenská obchodná inšpekcia (Slovak Trade Inspection), central inspectorate, department for international relations and alternative consumer dispute resolution, Bajkalská 21/A, 827 99 Bratislava 27; email ars@soi.sk. Information and admissibility conditions: soi.sk. Your right to go to court remains unaffected.
10. Personal data and advertising
Our Privacy Notice explains personal-data processing, GYMIFY, cameras and optional advertising. Our Cookie Notice explains website technologies and choices. Accepting these terms is not consent to analytics, personalised advertising, email matching or newsletters. Rejecting advertising does not affect your ability to buy or use our services.
11. Final provisions
Slovak law applies, particularly the Slovak Civil Code and Consumer Protection Act No. 108/2024 Coll. This choice does not remove any mandatory consumer protection applicable to the particular consumer under private international law. Court jurisdiction follows applicable legislation.
The version made available and agreed when a purchase is concluded governs that purchase. Later amendments do not automatically apply to services already bought. Ambiguities are interpreted in the consumer's favour; a translation discrepancy does not by itself reduce consumer rights. Invalid provisions do not apply and are replaced by statutory rules to the extent permitted by law.
